New Delhi Aug 19(ILNS): The Supreme Court issues notice to the Special Land Acquisition Officer Malaprabha Project Dharwad 3 and the Executive Engineer M.L.B.C.C., Karnataka in a matter where the claimant has approached this Court against the order passed by the Senior Civil Judge, Bailhongal seeking enhancement of compensation provided by the Tribunal.
The Matter was listed before the Division Bench comprising of Justice Indira Banerjee and Justice V. Ramasubramanian. After going through the facts presented by the Counsel of the Petitioner the bench has issued notice to the concerned authority and made this notice returnable within six weeks.
The petitioner has submitted before the Court that his land was acquired by the State on account of the submersion in the river Malaprabha reservoir project by issuing notification under section 4(1) of the Land Acquisition Act, 1894.
The reference Court has granted the market value of Rs. 40,000 per acre on the acquired land which was later enhanced to Rs. 3,00,000 as per the market value by the High Court of Karnataka along with all statutory benefits.
High Court of Karnataka has further held that the interest on this amount shall be provided from the date of award made by the Tribunal. Petitioners being aggrieved from this very point that the interest shall be computed from the date of award approached the Apex Court claiming that the interest must be provided from the date of acquisition of the Land./ILNS/KR/SNG
