Special Cell manipulated with files in my office: Pracha

New Delhi, Apr 7 (ILNS) Senior Advocate Mehmood Pracha today told the Delhi High Court that the Special Cell has manipulated with the files related to the case pertaining to the raids conducted on his office.

Mr Pracha gave these arguments before Chief Metropolitan Magistrate Dr Pankaj Sharma, while moving an application, seeking preponement of the date of hearing in the said matter.

“They are manipulating the case files in this matter. How’s it a coincidence that whenever I’m at the receiving end, the files are missing and this is happening from Day 1,” he argued.

The said allegations came in regarding a previous hearing of April 5, wherein Special Public Prosecutor (SPP) Amit Prasad had appeared before the Court along with the Inspector at 1400 hrs, but since the case was not with the court at that time and Mr Pracha wasn’t present in the court, the matter was deferred to April 25.

The SPP, making a strong objection to the allegations levelled by Mr Pracha, argued, “FIRs cannot be registered on the claims made by Mr Pracha in the air. He (Pracha) doesn’t know how to maintain decorum in the court. If we have not done something, then why should we face such statements that are coming.”

Commenting on Mr Pracha’s absence on the previous date, Mr Prasad argued, “We didn’t go for the rally on the date of hearing. It was he, who made a choice. He wanted to be present in rally and not in court, to give preference to a rally than to court.”

“The court has to step in somewhere. What is prima facie proof that we have manipulated the files?,” asked Mr Prasad, while adding that there are CCTV cameras in the said branch and it can be checked if the prosecution did something, as being alleged by Mr Pracha

“You don’t have to go the branch to manipulate the files, (this can be done) even on one phone call,” Mr Pracha argued.

After hearing both the sides, the court allowed application moved by Mr Pracha for an early date and slated the matter for further hearing on April 13.

The senior Advocate had moved the application against the second raid conducted by the Special Cell in his office on March 9, calling the whole exercise as “completely illegal and unjustified”.

Mr Pracha contended in his plea that the second raid was conducted in his absence, wherein more than 100 police personnel searched his office, while he was appearing before the Court of ASJ Dharmender Rana.

He said that Police, while searching his official premises on December 24 and 25, 2020, have already collected all the documents and seized them in a pen drive. 

According to Mr Pracha, the whole exercise was conducted with the “sole objective of illegally stealing the entire data” of the sensitive cases he has been dealing with, in which the Special Cell itself is the investigating agency.
