A Single Judge Bench of Justice Rekha Palli directed the agency appointed for maintenance of Sewage Treatment Plant to ensure, no inconvenience is caused to the Residents of Gautam Nagar, furthermore, directing AIIMS to ensure, that all necessary approvals are revalued, from time to time.
The petition was disposed of pursuant to the statement of AIIMS being taken on record, stating it will continue to ensure the STP does not cause any inconvenience to Residents of Gautam Nagar.
The petition was filed by Gautam Nagar Residents Association, alleging that the STP is being installed just 30 feet from the residential area which may lead to health hazards for the residents nearby.
The petition read: “There is a higher risk of inhabitants being irritable and moody. There is a higher risk of gastrointestinal diseases. There is also a risk of prevalence of pathogenic airborne micro-organisms originating from the waste water treatment plant. So, the installation of STP within such close proximity of the residential area called Gautam Nagar is a clear violation of fundamental rights guaranteed under Article 21 of the Constitution of India.”/ILNS/SR/KR/SNG
