SC refuses to hear PIL challenging Kerala HC order on 11th Pay Commission recommendations

New Delhi, Apr 20 (ILNS) The Supreme Court today refused to hear a petition, challenging an order of the Kerala High Court, in which it had dismissed the plea seeking direction to quash the 11th Pay Commission recommendation to increase the salaries of Government employees and pension of the retired employees of the state on the ground of total violation of the recommendation made by the 10th Pay Commission.

While dismissing the plea, a three-Judge Bench of Chief Justice SA Bobde, Justice AS Bopanna and Justice V Ramasubramanian refused to hear the matter. 

The petition, filed by Our Independent Organisation of People, had sought for a mandamus, directing the respondents to reconsider the implementation of the 11th Pay Commission. 

The Kerala High Court had dismissed the petition, saying, “When the petitioner seeks to quash the 11th Pay Commission recommendation to increase the salary of Government employees and pension of the retired employees of the state, at the same time, it also seeks implementation of the 11th Pay Commission, to increase the pension of agricultural labourers and age old pension.”

The petitioner had also sought for a mandamus, directing the State of Kerala, represented by the Chief Secretary and the Principal Secretary, Department of Finance, and the Principal Secretary, Department of General Administration/ respondents 1 to 3 respectively, to increase the pension of agricultural labourers and age old pension, in parity with the pension of its employees covered under the 11th Pay Commission.
