SC dismisses bail plea under UAPA for making team for terrorist training in Pakistan

New Delhi, Jun 11 (ILNS) The Supreme Court today dismissed a bail application filed by an accused, who was convicted for storing ammunition and fake Indian Currency, in addition to making a team for terrorist training in Pakistan.

A Divisional Bench of Justice Indira Banerjee and Justice MR Shah noted, “If this SLP for bail is pending, how has High Court released you on parole? We take strong objection to this. You should have come here Mr.”

The bail application was filed by Hafiz Abdul Majeed, who was convicted for offence under Section 18 (Punishment for Conspiracy), 18B (Punishment for recruiting of person for terrorist act) and 20 (Punishment for being member of terrorist gang or organisation) of the Unlawful Activities (Prevention) Act.

On November 24, 2020, the apex court had granted interim bail to two UAPA convicts for one month to take care of their parents. Majeed, Arun Kumar Jain and some others were were awarded punishment of life imprisonment.

Advocate Arif Ali Khan, appearing for the petitioner, submitted, “I am seeking bail on humanitarian condition. My father is really unwell. Petitioner is the only son, and has served for 14 years. On same grounds, this court had earlier granted bail for one month.”

However, the Court said, “Knowing fully well that we wouldn’t have extended the time, you approached HC. You shouldn’t have gone to HC for parole, when your SLP was pending here.”

The Bench, while dismissing the bail application, noted, “Your application for extension of surrendering was rejected by this court on December 18. That’s why you went to the HC. Your conduct is not bona fide.” ILNS/GM/RJ
