SC allows corporator to file additional documents in disqualification plea


New Delhi, Jun 8 (ILNS): The Supreme Court today allowed Rukmini Madegowda of Janata Dal (S) to file additional documents in a plea, which challenged the Karnataka High Court’s order disqualifying her election as councilor for not submitting the details of assets in the affidavit filed with nomination papers in 2018.

A Division Bench of Justices Indira Banerjee and MR Shah passed the order on a petition filed by Rukmini, challenging the order of the Karnataka High Court, which had upheld the order of the district court by which her election to the Mysore Municipal Corporation as a Councilor representing Ward No 36 Yerganahalli had been set aside.

The Karnataka High Court upheld the order of the District Court, stating that the outcome of the elections had been materially affected and the appellant’s election was liable to be held as void and the fourth respondent was entitled to be declared as the returned candidate.

Senior Advocate Shyam Divan, appearing for Madegowda, referring to the State Rule for Municipal Elections, submitted that the rules do not require submitting the details of the assets.
Another counsel submitted that the petition will become infructuous as the elections are scheduled on June 10, to which the bench said, “then, you should have come earlier.”
The bench has listed the matter for further hearing on June 15, Tuesday while allowing the petitioner to file additional documents on record. ILNS\GM\SJ\RJ
