Rajasthan Sept 6(ILNS): The Rajasthan High Court on August 03, stayed the construction of any road passing through any of the lakes in Udaipur.
The Division Bench comprising of Justice Sangeeta Lodha and Justice Vinit Kumar Mathur passed this order while hearing a suo moto cognizance in an application for stay of tender notices issued in this regard.
The applicant has prayed for reopening of the proceeding in the D.B.Civil Writ (PIL) Petition, which stands close by virtue of orders dated February 2, 2018, and February 17, 2018, passed by the Court.
The grievance of the applicant in the stay Petition is that ignoring the directions of the Court issued for cleaning of the lakes in Udaipur, the Udaipur Smart City Limited has issued a notice inviting tender for construction of alternative road from Chandpole to Brahmpole passing through the perimeter of Pichola lake.
Counsel appearing for the respondent-UIT submitted that though the notice inviting tender was issued, no tender was received pursuant thereto and therefore, the contract has not been awarded till this date.
Counsel further submitted that there is no possibility of the construction work of the proposed road being commenced in the near future.
The Court allowed two weeks time to file a reply to the stay Petition to the Additional Advocate General and Counsel appearing for the respondents UIT, Udaipur, and Udaipur Smart City Limited.
In the meanwhile and until further orders, no road passing through any of the lakes in Udaipur shall be constructed by the respondents, the Court ordered.
The Court has fixed the next hearing of the Petition on September 17, 2021./ILNS/AP/SNG
