Plea in Supreme Court challenges Uttarakhand High Court’s decision to resume physical hearing

New Delhi Aug 23(ILNS): A plea has been filed in the Supreme Court challenging the notification issued by the Uttarakhand High Court stating that the requests for Virtual Hearing will not be entertained as High Court will resume normal judicial work through physical mode with effect from August 24.

The matter was mentioned before the Bench comprised by Chief Justice NV Ramana. The plea is filed by the All India Association of Jurists and Lawyers. But the CJI refused to allow mentioning as the mentioning was not done through the proper channels.

The plea also prays to declare that right to access to Virtual Courts through video conferencing is a facet of the fundamental right guaranteed under Part III of the Constitution of India of both the council and the client.

The Uttarakhand High Court on August 16, 2021, had issued a notification stating that the Court will resume normal judicial work through physical mode w.e.f. 24.08.2021, and no request for a virtual hearing will be entertained by the High Court.ILNS/KR/SNG
