PIL in Allahabad HC, seeking probe into death of Mahant Narendra Giri, suspension of DM and SP to enable fair investigation

Allahabad, Sept 21 (ILNS) A Public Interest Litigation (Letter Petition) has been filed in Allahabad High Court,  seeking CBI inquiry into the suspicious death of Mahant Narendra Giri President of Akhil Bharatiya Akhara Parishad.

The PIL, filed in a form of Letter, is filed through Lawyer Sunil Choudhary, in-Person. seeking immediate suspension of the District Magistrate and Special Superintendent of Prayagraj.

The PIL says that the petitioner came through the news through a reliable portal of a daily newspaper on September 20, 201 about the mysterious death of President of Akhada Parishad Mahant Narendra Giri found hanging in his room inside ashram at Bagambari Gaddi Matth at Allahpur, Prayagraj.

Petitioner through his other sources inquired into the matter in which the residents of Baghambari Gaddi stated that due to huge financial misappropriation this incident took place and they also stated that the Mahanat Narendra Giri was provided security by the state of UP so how is it possible that he died in a mysterious way in the presence of large number of disciples and securities.  

The PIL highlighted that the news denotes that high rank police officer and land mafia is involved in the case. After the death of Narender Giri, Prayagraj police arrested 3 persons. The mysterious death of Mahant Narendra Giri was an idol of Hindus and had millions of followers.The entire country was shocked and the law and order of Prayagraj is in great danger due to this incident.

The petitioner contended that when higher police official are involved in the matter then how it is possible to proceed with fair investigation by the Prayagraj police if they are being categorized in the list of suspects, so to  enable fair investigation this court must take suo motu cognizance into the matter as early as possible, the Petitioner submitted.  

It is alleged in the Petition that under Article 21 of Indian Constitution which guarantees a citizen of India ” Right to life and personal liberty,” State machinery has failed to secure the life of the deceased Mahant Narendra Giri .  

Justice P.N Bhagwati had introduced a concept Public Interest Litigation through Letter Petition to save the integrity or judicial approach over the matters related to public interest which need to be accepted by constitutional courts in the interest of justice.  

“That in the view of facts and circumstances of the case it is necessary in the interest of justice that the Court may accept this present Public Interest Litigation through this Letter Petition and may take suo motu cognizance against the Respondents and others who are responsible for the occurrence of the death of President of Akhada Parishad, Mahant Narendra Giri found hanging in his room inside ashram, the PIL reads./ILNS/SS/SNG
