Mukhtar Ansari’s wife moves SC, fearing threat to his life

-

Lucknow, Apr 6 (ILNS) The doors of the Supreme Court were knocked today by Mukhtar Ansari’s wife, seeking security and protection to her husband, while he was being shifted to Banda jail.

Petitioner Afshan Ansari stated in her petition that there lies an imminent threat to her husband’s life (on account of having successfully contested elections against BJP and being witness to cases against members of BJP in UP).

She said she feared that unfair trial could be given to Mukhtar Ansari and that an unforseen encounter could also take place in the process of participating in the same.

The petitioner further alleged that mafia don Brijesh Singh, who had become highly influential in the state of Uttar Pradesh, even after being incarcerated in jail, continued to be a constant threat to the life of her husband.

The petition also referred to a political rivalry between Brijesh Singh and the petitioner’s husband, which was well known in the state of Uttar Pradesh. She said her worries had also grown, since the associates of Brijesh Singh had remarked publicly to take away the petitioner’s husband’s life.

Ansari has 38 cases lodged against him at Ghazipur police station in UP . He is also accused in the murder of BJP MLA Krishna Nanda Rai, whose wife and BJP MLA Alka Rai had recently written in a letter to Congress General Secretary Priyanka Gandhi Vadra, accusing the Congress government in Punjab of helping Ansari to evade court proceedings.

Ansari has been co-accused in the murder case of BJP MLA Krishna Nanda Rai, along with one Munna Bajrangi, who was found dead under mysterious circumstances in jail.

Munna Bajrangi was planned to be shifted to District Jail Baghpat, for which an application was filed on his behalf to produce him in the Court from District Jail with police protection as he was apprehending a state-sponsored encounter. However, nothing was done and on July 9, 2018, Munna Bajrangi, under the pretext of being shifted from one jail to another under “TALARI” warrant, was found murdered within the jail.

The petition further submitted that the conduct of the State of UP in dealing with accused Vikas Dubey was highly criticised, where while transferring him to the prison, he was encountered on the way. Similar reports were being given in the press in relation to her husband, the petitioner noted.

She quoted yet another example of Girdhari, who was alleged to be the shooter in the murder case of one Ajit Singh, who was shot dead by Uttar Pradesh Police in an encounter on February 15, 2021, while taking him in police remand, on which the Supreme Court has taken cognisance. In such circumstances, it cannot be expected from the State of Uttar Pradesh to secure the fundamental rights as provided to the petitioner’s husband in the Constitution, but for necessary directions passed by the Apex Court, the plea contended.

It further stated that constant harassment has been caused to the petitioner and her family under influence of political pressure due to the multiple false, frivolous and bogus FIRs been registered under various Sections of the IPC and Arms Act against the petitioner’s family, including her sons Abbas Ansari and Umar Ansari, national level gold medalist and state level medalist sportsmen respectively, with an intention to spoil their career.

With the political rivalry, the officers have demolished their house located in Dalibagh in Lucknow that was constructed by the petitioner’s mother-in-law late Rabiya Begum, without any prior notice and took a proceeding against a demised person, which was against the principle of the natural justice.

The petition read that they have been informed from sources that some shooter in the guise of a lawyer along with the lawyers will carry out the ruthless killing of her husband during the course of his appearance in trial before the Special Judge (MP/MLA), UP.
The petitioner has claimed that the plans are being made by some higher rank officers at the behest of the Government of Uttar Pradesh.

She added that criminal Brajesh Singh MLA, who is currently in Banaras jail and is the bitter enemy of the Petitioner’s husband along with BJP MLA Sushil Singh, criminal Tribhuan Singh, and Alka Rai, have made plans to kill Mukhtar Ansari.

The petitioner did not fail to add that during the Budget session, Chief Minister of Uttar Pradesh Yogi Adityanath had represented her husband as ‘guilty’ and the Ministers had openly said “how long the mother of the goat will celebrate”.

The petitioner prayed for additional security to the accused and his family, in view of the above circumstances. ILNS/SNG/CJ/RJ
