Madhya Pradesh Sept 3(ILNS): The Madhya Pradesh High Court recently directed Collector, District-Rewa to conduct a detailed inquiry into the matter regarding encroachment over public land as raised by the Petitioner.
The Petition has been filed by one Ramanauj Pandey in the nature of Pro Bono Publico (for the public good) for suitable direction for removal of encroachment on Public Road and Government property measuring 4.33 acres, Ward No.8, Anand Nagar, Bodabeg, District-Rewa.
The Division Bench comprising of Chief Justice Mohammad Rafiq and Justice Pranay Verma after hearing Counsel for the parties, disposed of the Petition by directing Collector, District-Rewa to conduct a detailed inquiry into the matter regarding encroachment over public land as raised in the Petition.
The contention of the Petitioner is that encroachment over land total measuring 4.33 acres in various Khasra numbers as mentioned the Petition has been made by various persons resulting in a reduction of the width of the public road as a result of which general public is suffering difficulties and accidents on daily basis.
Rajkumar Tripathi, Counsel for the Petitioner further submitted that the Petitioner has submitted various representations to Respondents Authorities but no action has been taken.
The Court while disposing of the petition directed the Collector, District Rewa that while conducting such inquiry, Collector, he shall give due opportunity of hearing to all persons who may be affected by such inquiry as well as to the petitioner. If in such inquiry, Collector finds any encroachment over any Government land having been made by any person, he shall take the necessary steps for removal of such encroachment as per law”, the court directed./ILNS/SS/SNG
