Madhya Pradesh HC directs Tikamgarh SP to examine and take action on facts presented by petitioner related to an alleged murder


Madhya Pradesh Aug 7(ILNS): The Madhya Pradesh High Court has directed the Superintendent of Police, Tikamgarh to examine the murder allegations leveled by the petitioner against the respondent and take action accordingly.

A Single-Judge Jabalpur Bench comprised of Justice Sanjay Dwivedi, while considering the factual circumstances existing in the case on August 4, directed the Superintendent of Police, Tikamgarh, to consider the grievance of the Petitioner and also take note of the call details.

The Bench further directed that if the authority thinks so, then it can make a further investigation to enquire about the conversation made between the deceased (nephew of the petitioner) and private respondent and if something mischievous is found, then the authority is free to proceed further in the alleged offense.

“It is totally upon the Superintendent of Police, Tikamgarh, to examine the aforesaid and do the needful,” noted the Court and disposed of the petition.

The petition has been filed by Tulsidas Ahirwar, seeking direction to police for conducting proper inquiry and investigation into the incident of the suicide of one Shankar, nephew of the petitioner. The deceased has been said to have committed suicide, but according to the petitioner, it was not a suicide, but a murder committed by the private respondent, as he was facing a criminal case and departmental inquiry because of a complaint made by the present petitioner.

Arti Dwivedi, Counsel for the Petitioner, submitted that the private respondent was creating pressure upon the petitioner for changing his statement or to get the matter compromised, but the petitioner was not ready for that and the private respondent being a very influential person, was giving threat to the petitioner that if a compromise is not done, then he would cause damage to the petitioner’s family.

She further submitted that on the date when the nephew of the petitioner was said to have committed suicide, there was a telephonic conversation between the deceased and private respondent just prior to the incident. It is apprehended by the petitioner that the deceased has been called by a private respondent and with the help of some unsocial elements, he was killed and shown to have committed suicide.

Reply has been filed by the respondents/State stating therein that the matter has been investigated and nothing as has been apprehended by the petitioner, has been found, therefore, the case was registered as a suicidal case and no further investigation was required.

Later, a Rejoinder was also filed on behalf of the petitioner reiterating the same facts and mentioning therein that the call details submitted by the petitioner have not been taken note of by the Superintendent of Police, District-Tikamgarh./ILNS/SS/SNG
