New Delhi Aug 28(ILNS): A lawyer from Delhi has written to Attorney General KK Venugopal seeking permission for proceeding with criminal contempt of court against Chandrashekhar Azad “Rawan”, President Bheem Army, Leader of Azad Samaj Party for scandalizing the Indian Judiciary and disgracing its dignity.
Advocate Vineet Jindal referred to the recent interview of the Chief of Bheem Army which was aired on a news channel on 27th August 2021 and also widely speculated on the internet in which Chandrashekhar Azad “Rawan” has passed derogatory and scandalous statements about the Supreme Court of India and its judges.
In his video interview of 8.27 minutes Chandrashekhar remarked upon the collegium system” ye savidhaan me koe pravadhan nai hai, is tarike ka, ye to yahan ke logo ne bana diya jo judge baithe hue hai, ki collegium, ki collegium kaise tay kardega, judge ka beta judge, judge ka bhatija judge, judge ka dammad judge, judge ka bhai judge, ye kya baat hue, dalito mein, pitchdo mein, muslimo mein pratibha nai hai … “, the letter states.
Jindal averred that “Chandrashekhar Azad “Rawan” by stating the above statement has scandalized the process of selection of the judges on the basis of the collegium. As per his statement, the selection is done solely on the basis of the personal relations or family relations of the selected judges with the sitting judges. Thereby Chief of Bheem Army has alleged that the selection process is totally biased and that it takes place in the interest of sitting judges and their family members.
Moreover, the letter further said that in the interview Chandrashekhar has said that “kissi ne 50 crore ka ghotala kiya, aur vo apni setting se 2000 crore kissi samanit vyakti se transfer karwa de to 48 crore rupay nagad bach gaye, order aa jata hai uske favor mein , janta dekh rahi hai, mujhe ye kehne mein koe dikkaat nai hai ki bada ghotala vahan se ho raha hai, sabki janch honi chahiye, Supreme Court ke jitney judge hai unki janch honi chahiye unki sampatti ki itni sampaati kahan se aayi, aur uska kya source hai, tankha se alag konsa business kar rahe hai ki itni sampatti aaa gayi hai ….. “.
Advocate Jindal alleged that ”Rawan” has made the above statements directly with intent to disgrace and scandalize the sitting judges of the highest Court the Supreme Court of our country.
The statements by Chandrashekhar Azad “Rawan” has scandalized the judgments passed by the Supreme Court judges and accusing them of being corrupt. “If this kind of precedent were allowed, political leaders would start making a reckless allegation against the judges of the highest Court of our country and this trend would soon lead to the failure of an independent judiciary system’, Jindal concerned.
It is highlighted that Chandrashekhar through the statement has dishonored the Judges of the Supreme Court who are the guardians of the entire legal system and disgraced as well as jeopardized the integrity of the entire judicial system. This kind of statement would affect the masses by a growing sense of mistrust and concern among the public about the fall in the standards of the judicial system.
“I am therefore seeking your kind consent under section 15 (1) (b) of the contempt of courts Act 1971, read with rule 3 of the rules to regulate the procedure for the contempt of the Supreme court 1975 to initiate criminal contempt against Chandrashekhar Azad “Rawan”, the letter reads./ILNS/SS/SNG
