New Delhi, May 1 (ILNS): The Delhi High Court bench of Justices Vipin Sanghi and Rekha Palli, hearing a suo motu plea regarding the shortage of beds, drugs and oxygen supply etc amid the Covid-19 pandemic today hit out at the Central government and warned that it will hold the government in contempt if Delhi does not gets its allocated 490MT of oxygen by today itself.
The court directed the Central Govt to supply oxygen by whatever means. Justice Sanghi said: “Do you want us to let people die in Delhi? Do u want us to shut our eyes?”
The immediate issue was of eight deaths due to lack of oxygen at the Batra hospital, which has created a furore. The judges consulted between them and then issued his order.
The bench ordered: “We direct the Central government to ensure that NCT of Delhi receives its allocated supply of 490 MT positively today, by whatever means. Considering the fact that Delhi is not an industrial State, and does not have availability of cryogenic tankers of its own which could be requisitioned under the Disaster Management Act – like other states have done, it falls upon the Central government to arrange the tankers as well, so that the allocation made to Delhi could be fulfilled, else it remains only a paper allocation. The Central government shall ensure availability of cryogenic tankers as well for the said supply.
Pertinently, the allocation to Delhi which was earlier of 480 MT (since April 20), and now is of 490 MT has not been fulfilled even for a single day. In case, this order is not implemented, the concerned officers of the Central government viz. Mr Piyush Goyal and Ms Sunita Dawra shall remain present during the hearing on May 3.
Looking to the situation, we make it clear that we may even consider initiating contempt proceedings in case of non-compliance. Mr Amit Mahajan shall ensure communication of this order to the concerned officers forthwith.” ILNS\KR\SJ
