Gauhati Aug 27(ILNS): The Gauhati High Court recently, directed the Deputy Commissioner, Bongaigaon to inspect the area and file a report giving his suggestions on the matter of laying of a Railway track over the village road in Salmara Pt-II (Ujanpara).
The Public Interest Litigation(PIL) has been filed by Ratneshwar Baruah and 43 others having grievance that because of laying of a Railway track over the village road in Salmara Pt-II (Ujanpara), the said village has been divided into two parts, namely, Northern part of North Salmara Pt-II (Ujanpara) and Southern part of North Salmara Pt-II (Ujanpara).
The Division Bench comprising of Chief Justice Sudhanshu Dhuliya and Justice Manash Ranjan Pathak while considering the importance of the matter, which relates to the safety and welfare of many inhabitants near a railway level crossing for several years directed the Deputy Commissioner, Bongaigaon to inspect the area and file a report before the High Court giving his suggestions.
The connectivity between the two parts of the said village has been disrupted because of the non-provision of any manned level crossing which has also posed a serious threat to the lives of the villagers especially the children and elderly persons including cattle.
“Registry shall supply a copy of the entire writ petition free of cost to the Deputy Commissioner, Bongaigaon along with the counter affidavit of the Railway authorities in order to facilitate the inquiry. Let the inquiry be completed within three weeks. List after four weeks”, the order reads./ILNS/SS/SNG
