Delhi HC grants protection to couple from family members

New Delhi, May 26 (ILNS) The Delhi High Court has granted protection to a couple, who wanted to live together against the wishes of their family members, while stating that petitioners are major and they (family members and associates) cannot create any hindrance in their life, till they stay together on their own wish and consent.

The Single-Judge Bench of Justice Suresh Kumar Kait yesterday directed the SHO of Sarita Vihar, Police Station to provide security to the couple till they reside in Delhi, to avoid any untoward incident.

“I hereby, make it clear that family members and associates of petitioners shall not create any hindrances in their life,” said Justice Kait, while disposing of the petition.

The Court pronounced its Judgement on a petition filed by Shivani, who wanted to live with her partner against the wishes of her family members and had sought the Court’s directions to her father and uncle and their associates, who almost tried to get her married against her wishes, if she hadn’t left the home with her partner.

Her family also lodged an FIR against her partner in Meerut, the State of Uttar Pradesh under Section 366 IPC for kidnapping/abduction.

The Delhi High Court had earlier issued a notice on the petition and directed the Delhi Police to provide them protection and accommodation. The Court has impleaded the Investigation Officer of the UP Police and directed him to get the FIR cancelled before the concerned court within a week and no coercive steps shall be taken against her boyfriend.

During the hearing of the case, the couple presented themselves virtually and the girl stated that she has not been abducted, induced or influenced by her boyfriend and they are in love with each other and they want to get married.

The Court directed the IO UP Police to consider the same as the statement made under Section 161 CrPC and take steps for cancellation of the FIR against her boyfriend.  ILNS/AYG/RJ
