Delhi HC defers hearing in INC leader Bavya Bishnoi seeking permission to travel for post-graduation, accused under Black Money Act


New Delhi Aug 3(ILNS): The Delhi High Court today deferred hearing in a plea seeking permission to travel abroad for two years for post-graduation filed by Indian National Congress leader Bhavya Bishnoi, son of Mr. Kuldeep Bishnoi, MLA, Adampur, Haryana, and Ms. Renuka Bishnoi, MLA, Hansi, Haryana accused under Black Money Act, 2015.

The Single-Judge bench of Justice Rekha Palli came to this conclusion after the counsel for Union of India, Ms. Vibhuti Malhotra requested the court for a short date as they wanted to submit information in a sealed cover before the court, the court also directed the Advocate for the petitioner Mr. N.P Sahni to file rejoinder before the next day.

Mr. Sahni informed the court that the petitioner has been able to secure admission in a two-year course, Master in Public Administration at the Harvard Kennedy School, John F. Kennedy School of Government, Cambridge, Massachusetts for which purpose he has to travel to the United States of America on August 10, 2021, and is ready to return to India when his presence is required. Mr. Sahni further stated that the case instituted against the petitioner is quoting properties from 1996-97 when the petitioner was aged three years old.

Ms. Malhotra informed the court that a complaint has been filed under Black Money Act, 2015 on July 30, 2021, and that the matter is listed at Magistrates Court on August 6, 2021. Ms. Malhotra also argued that if the petitioner is allowed to leave for two years, he can establish legal residency in the United States of America.

The petitioner had previously traveled to the USA from February 14, 2020, to March 1, 2020, and to Dubai on February 24, 2021, to February 27, 2021, after furnishing a Security of AG-059 (Old No.FLG04), Phase-I, Ansal Plaza, Greater Noida, UP and a surety of five lakh rupees with the Registrar General of the Delhi High Court.

 The petitioner had contested the Lok Sabha elections in 2019 from Hisar on an Indian National Congress ticket, losing to Brijendra Singh of Bhartiya Janta Party.

The bench has listed the matter for further hearing on August 4, 2021./ILNS/GM/SV/SNG
