Delhi HC defers hearing in a habeas corpus plea filed by Gulfisha Fatima accused under UAPA


New Delhi, June 18 (ILNS): The Delhi High Court today has adjourned hearing on a habeas corpus plea filed by Gulfisha Fatima accused for offences under UAPA, seeking release from judicial custody. 

A Division Bench comprising Justice Naveen Chawla and Justice Asha Menon have adjourned Fatima’s Habeas Corpus plea to July 5 while saying that the court is burdened with a heavy board and does not have time to hear the said plea. The matter will be heard by the roster bench after the vacation.

She has been charged under various sections of UAPA for being involved in the riots that happened in the North-East parts of Delhi from 22.02.2020 to 26.02.2020. It is alleged that she was part of a “Larger Conspiracy” behind inciting the Northeast Delhi Riots that took place in February 2020. 

Fatima’s co-accused, Natasha Narwal, Devangana Kalita and Asif Iqbal were released from Tihar Jail on Thursday in compliance of bail order granted by The Delhi High Court on 15 June. 

They are accused of being the masterminds behind the conspiracy that led to the North-East Delhi violence in February 2020. The allegation against them is that they wanted to disturb the law and order of the National Capital as a reaction to the Citizenship Amendment Act enacted last year. 

Today, the Supreme Court has issued notice in an appeal filed by the Delhi Police challenging the said verdict of the High Court & said that the impugned judgment shall not be rely as a precedent by any of the parties before any court. “It is clarified that release of the respondents (Asif Iqbal Tanha, Devangana Kalita & Natasha Narwal) at this stage not interfered with,” it added.(ILNS)AR/KR
