Patna Aug 4(ILNS): The Patna High Court, recently, denied anticipatory bail to two men who allegedly posted on social media took vulgar and obscene photographs with an idol of Goddess Saraswati .
A Single Bench comprised of Justice Sudhir Singh while considering the facts of the case rejected the anticipatory bail Petition.
The Petitioners, Ravi Kumar @ Ravi Ranjan and Sahendra Ram are apprehending their arrest in connection with the Kutumba P.S. case registered under Sections 153(A), 506/34 of the Indian Penal Code and 67 of I.T. Act, pending in the Court of A.C.J.M. III, Aurangabad.
The prosecution case is that the accused persons took very vulgar and obscene photographs with the statue of Goddess Saraswati and made it viral on social media platforms.
Yugal Kishore Counsel for the Petitioners submitted that the Petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the Petitioner. The Petitioners have falsely been implicated in the case. As per the allegation, vulgar photographs of idol Saraswati were uploaded on social media. The allegations are denied by the Petitioners.
Zainul Abedin, Additional Public Prosecutor submitted that the Petitioners are named in the F.I.R. The Petitioners were also involved in uploading such vulgar photographs of idol Saraswati on social media. The photographs are part of the F.I.R.
“If the petitioners surrender before the court below ( A.C.J.M. III, Aurangabad) and pray for regular bail, the same shall be considered on its own merit without being prejudiced by this order. If possible, the regular bail is disposed of preferably on the same day”, the order reads./ILNS/SS/SV/SNG
