Allahabad Sept 18(ILNS): The Allahabad High Court recently recalled its order in which it had directed the listing of a matter before another bench citing the “mischievous behavior of the advocate”.
The Division Bench comprising of Justice Kaushal Jayendra Thaker and Justice Subhash Chand while hearing a First Appeal filed by Raja Ram, said that, on September 06, 2021, while hearing these applications, which are pending for a long, we had inquired from the Advocate that the delay was condoned in all the matters, as all the matters were to be heard together.
The Court further said that, at that time, the Advocate had not addressed the Court properly and, therefore, we have passed the order of listing these matters before any other Bench.
On Monday, the Court stated that the Senior members of the Bar and the President have requested us to recall the order though not requested by the council, who had misbehaved.
“While going through the record except for F.A. No. 1028 of 1995, in no other matters delay condonation applications, are allowed. Be that as it may, we recall the order dated September 06, 2021. List the matters on September 17, 2021, after giving a copy to the council, who has replaced Amit Manohar, Advocate. All the documents or the judgments that the council wants to rely on may be filed in the Registry during this period”, the order reads.
Later, on September 17, 2021, the delay in filing of appeal was thereby condoned in First Appeal Nos. 190 of 1998, 267 of 1998, and 1028 of 1995./ILNS/AP/SNG
