Allahabad HC issues Bailable Warrants to Director Secondary Education for not complying with his own affidavit

Allahabad, Oct 21 (ILNS) The Allahabad High Court on Monday issued a bailable warrant to the Director Secondary Education, Uttar Pradesh, Lucknow for not honouring his own undertaking stated an affidavit filed in the court and directing him to appear before it on November 8, 2021.

A Single Bench of Justice Saral Srivastava directed the Director Secondary Education, Uttar Pradesh to appear before it on November 8, 2021, and explain as to why he had not taken care of his own undertaking, as was furnished by him vide affidavit dated December 11, 2018.

On September 27, 2021, the Court while hearing a petition filed by Ved Prakash And 3 Others. passed the following order:-

“In pursuance of the order dated October 29, 2018, Working Director (Secondary Education, U.P., Lucknow) filed his affidavit on December 11, 2018, seeking further six weeks time to make compliance and for passing a detailed order after hearing the parties, but thereafter, no supplementary affidavit has been filed on record, which demonstrates that prima facie, Director has not taken care of his own undertaking, as was furnished by him vide affidavit dated December 11, 2018.

In such facts and circumstances, Director of Education (Secondary), U.P., Lucknow is directed to again file a personal affidavit, showing further compliance in furtherance of the averments made by him in his affidavit dated December 11, 2018, within two weeks from today, failing which, Director of Education (Secondary), U.P., Lucknow shall remain personally present. List this case on October 18, 2021.”

Amit Kumar Singh, Additional Chief Standing Counsel states that the Court’s order dated September 27, 2021, has been communicated to the Director of Education (Secondary), U.P., Lucknow, through FAX, but despite the same, no response has been received by the office of Chief Standing Counsel from the Director of Education (Secondary), U.P., Lucknow.

“In such view of the fact, let a bailable warrant be issued against the Director of Education (Secondary), U.P., Lucknow through the C.J.M. concerned.

Let a copy of the order be sent to the C.J.M. concerned for compliance”, the Court ordered.

The Court fixed the next hearing of the petition on November 08, 2021./ILNS/AP/SNG/
