Allahabad HC directs secretary UP board to decide in two months posting of the selected teacher to the post of principal

Allahabad, Sept 30 (ILNS) The Allahabad High Court on Monday directed the Secretary of the UP Secondary Education Service Selection Board, Prayagraj, to take a decision in two months regarding the posting of the selected teacher from the Education Board to the post of principal.

A single-judge bench of Justice Saral Srivastava passed this order while hearing a petition filed by Ram Narayan Mishra. The petitioner, in response to an advertisement published by U.P. Secondary Education Service Selection Board dated June 27, 2011, inviting applications for recruitment of Principal in Intermediate College, submitted the application for appointment.

The petitioner was selected and was allotted Rashtriya Inter College Shahpur, Muzaffarnagar. According to the petitioner, he made his best efforts to join as Principal in the said College but the Committee of Management of the College did not permit him to join the College.

The District Inspector of Schools, Muzaffarnagar also wrote a letter on August 24, 2019, to the Manager of the College asking him to permit the petitioner to join the College. Despite the said letter, the Manager of the College did not permit the petitioner to join the College.

The petitioner said that, in the meantime, the post of principal fell vacant in Bhadaon Intermediate College Thalaipur, District Mau due to the retirement of the principal of the said college and the petitioner being the senior-most lecturer in Bhadaon  Intermediate College Thalaipur, District Mau, was given an ad-hoc promotion to the post of principal of the college.

The petitioner further said that the post of Principal with respect to Bhadaon Intermediate College Thalaipur, District Mau has also been advertised in the same advertisement issued in 2011 and substantive vacancy in the College is existing, therefore, the petitioner claims that he may be adjusted as Principal in Bhadaon Intermediate College Thalaipur, District Mau.

Counsel for the respondents submitted that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to the competent authority, i.e., respondents to consider the grievance of the petitioner.

The Court disposed of the petition with a direction to the petitioner to file a fresh representation before the Secretary, Secondary Education Service Selection Board, Allenganj, Prayagraj, raising all his grievances within a period of two weeks.

“In case, any such representation is filed by the petitioner, the respondent no.2/Secondary Education Service Selection Board, Prayagraj shall consider and decide the same after giving due notice and opportunity of hearing to the Committee of Management of the College, namely, Bhadaon Intermediate College Thalaipur, District Mau/Prabandhak of the College, whoever is managing the affairs of the College, strictly in accordance with the law, by a reasoned and speaking order, preferably within a period of two months thereafter,” the order reads./ILNS/AP/SNG
